All brands, trade names or distinctive signs of any kind that appear on the Page are the property of PCE ESCUELA A DISTANCIA, SL or, where applicable, of third parties who have authorized their use, without it being understood that the use or access to the Portal and/or the Contents attribute to the User any right over the aforementioned brands, trade names and/or distinctive signs, and without any of the exploitation rights that exist or may exist over said Contents being transferred to the User. Likewise, the Contents are the intellectual property of PCE ESCUELA A DISTANCIA, SL, or third parties where applicable, therefore, the Intellectual Property rights are owned by PCE ESCUELA A DISTANCIA, SL, or third parties who have authorized its use, to whom corresponds the exclusive exercise of the rights of exploitation thereof in any form and, in particular, the rights of reproduction, distribution, public communication and transformation. The unauthorized use of the information contained on this Website, as well as the infringement of the Intellectual or Industrial Property rights of PCE ESCUELA A DISTANCIA, SL or of third parties included in the Page that have transferred content, will give rise to legally established responsibilities.
All prices shown on the website include the corresponding VAT where applicable unless expressly stated otherwise.
You are accessing a service provided over the Internet, with access to content related to the preparation for admission to Spanish universities. This access makes you a USER of Escuela PCE. In this document you will find the conditions under which the relationship between the USER and THE SUPPLIER will be regulated through these General Contract Conditions:
1. Access
Access to all services offered by Escuela PCE will be personal and non-transferable. To access this service as a user, you will have a username and password. These details are for your personal access, and the transfer of these keys to third parties or the use of false data to obtain them may result in the suspension of the service by the SUPPLIER.
2. User and services
As a user, you will have access to this service for a limited period of time that will allow you to enjoy the contracted course and the services included in it. The duration of the courses will be until the completion of the official test to which the training is aimed (examination) with a maximum duration, unless otherwise indicated in the course, of 6 months. During this time you will have free access to both the virtual campus and the contents, after this period Escuela PCE reserves the right to delete both the user's account and to indefinitely suspend access to the courses.
The USER expressly accepts that the use of all our content and/or services is solely and exclusively for natural persons outside the exercise of their commercial, professional and/or economic activity.
All the contents of the website (images, graphics, texts, manuals, tests, etc.) are protected by the Intellectual Property Law (RDL 1/1996, of April 12, which approves the consolidated text of the Intellectual Property Law) and, unless expressly authorized, Escuela PCE reserves all rights of use, marketing, distribution and exploitation.
The USER who makes inappropriate use of the service, does not maintain basic rules of respect, appropriate use of language and education by the rest of the USERS or with the SUPPLIER, facilitates access or content to third parties, attempts or resells the content. , or any other reason that threatens the interests of the SUPPLIER, may be terminated from the service by the SUPPLIER without any financial compensation or refund of the amounts paid for the service. All of this, without prejudice to the legal actions that the SUPPLIER deems appropriate to take towards the USER.
The USER must use truthful data during the registration process (full name, two surnames, telephone number, postal address and email address). Any account that does not meet this condition will be suspended as a precautionary measure until the user provides their exact data. Escuela PCE reserves the right to ask its users to send a copy of their national identity document, or equivalent according to regulations, for the activation and/or reactivation of the registration in order to verify said information.
In no case will it be understood that the use of initials and/or temporary email addresses are valid data.
In relation to the previous paragraph: Escuela PCE undertakes not to disclose at any time any data that would allow the full identification of its users beyond their initials in order to maintain anonymity and respect the right to privacy of its users.
3. Payments
Escuela PCE offers the following payment methods:
- Deposit/bank transfer: You can make payment via deposit or bank transfer for any amount. Once the registration is completed, our bankers will appear to be able to carry out the operation. It is important that you indicate your registration number in the application form (it will be provided to you during the process) as well as your full name to be able to unequivocally identify your operation. The activation period will be between 24 and 72 hours since it will not be processed until the transaction is reflected in our systems. This payment method does not carry any type of surcharge.
- Credit/debit card: you can pay with Visa, Visa Electron, Mastercard or Maestro cards for any amount. Escuela PCE has 3D Secure fraud prevention systems in place, such as “Verified by Visa” for Visa and “SecureCode” for Mastercard, so in order to make the payment you must have online purchases activated and when making a payment by card you will be asked to confirm your identity through the mechanisms established by your bank (SMS, date of birth, etc.). Once the operation is authorized by your bank, the registration will be automatically confirmed (except for occasional technical problems). This method of payment does not entail any type of surcharge.
4 Billing
The invoice for the contracted service may be sent by email and/or on paper to the address provided during the registration process free of charge upon request sent to [email protected]
5. Degree obtained
Escuela PCEAs a non-regulated training centre, we do not carry out training activities that lead to the issuance of any qualifications. Our job is to prepare the USER to take the different tests that our courses are aimed at.
6. Right of withdrawal
In relation to the products and services offered by Escuela PCE, and with regard to this clause, the conditions for exercising the right of withdrawal are determined based on the type of product and/or service contracted.
In the case of products and services in online mode, taking into account that the service offered is purely electronic, and that mere access to the different course(s) would constitute enjoyment of the contracted service (RDL 1/2007, of November 16, Royal Legislative Decree 1/2007, of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users, art. 103.m), Escuela PCE offers the possibility of cancelling the order within 14 calendar days immediately following the purchase and payment of the course, provided that the course has not been accessed on the virtual campus. To do this, we have "visit history" systems that will allow us to verify said activity.
The refund of the amounts paid will be made as soon as possible, always within a period of less than 14 calendar days from the processing of the refund request.
7 Warranty
"The seller is responsible for any lack of conformity that appears within a period of two years from delivery." Likewise, section 5 of article 123 of RDL 1/2007 recognizes that: "The consumer and user must inform the seller of the lack of conformity within a period of two months from when he became aware of it."
Taking into account that the website sells services that have a lifespan of less than two years, which are those provided by the regulations on consumers and users to deal with lack of conformity, these guarantees will be applied taking into account the nature of the goods marketed on the website or complete the information on terms and peculiarities of the guarantees with the following contained in Article 116 of the TRLGDCU (Conformity of the products with the contract):
«1. Unless proven otherwise, it will be understood that the products comply with the contract as long as they meet all the requirements expressed below:
a) They conform to the description made by the seller and possess the qualities of the product that the seller has presented to the consumer and user in the form of a sample or model.
b) They are suitable for the uses to which products of the same type are ordinarily destined.
c) They present the usual quality and performance of a product of the same type that the consumer and user can reasonably expect, taking into account the nature of the product (...). «
To make the guarantee effective, within the established period, you must send an email to the following address [email protected] indicating your full details (Name, Surname, ID) as well as the information necessary to unequivocally identify the product covered by the warranty.
8. User Responsibility
The USER shall be responsible for the safekeeping of his/her username and password, and shall therefore be liable for any improper use of his/her account. In the event that the USER is aware of any information that may compromise the security of his/her account, he/she must notify Escuela PCE as soon as possible in order to avoid any harm to itself or to the Supplier.
9. Disclaimer
Escuela PCE will not be held responsible for the content provided by users: If any of the content, files, information, advertising, opinions, concepts and images hosted on our website are contrary to the law, morality, good faith and public order or contain any type of computer virus or similar software routine.
10. Site Security
The entire website of Escuela PCE is located in a secure environment under SSL SHA-256 bits protocol. This technology allows the data entered on the screen, and that travels through the network, to be encrypted using an algorithm, with variable keys for connection.
Additionally, for services that have data of special sensitivity, Escuela PCE has established additional security mechanisms tailored to these services.
Our system has the technical capacity to detect unauthorized or fraudulent uses, and, consequently, automatically block those accounts in which such a situation is detected.
In order to avoid data loss, Escuela PCE It has different servers, located at different points, which will make, punctually, backup copies of all the content.
11. Service Availability
Escuela PCE, in order to offer a quality service to its users, may temporarily suspend the services to carry out maintenance or improvement tasks. Likewise, Escuela PCE undertakes, to the extent possible, to: notify all its users of such suspensions with sufficient notice and to carry out tasks, preferably, at night (where there is less user traffic to be expected).
Since these tasks will always be to improve the service of its users, there is no room for any type of claim in this regard.
12. Events beyond our control
We will not be liable for any failure or delay in performance of any of the obligations we assume under a Contract, the cause of which is due to events beyond our reasonable control ("Force Majeure Event"). Causes of Force Majeure will include any act, event, failure to perform, omission or accident that is beyond our reasonable control and, among others, the following:
1. Strikes, lockouts or other protest measures.
2. Civil commotion, riot, invasion, terrorist attack or terrorist threat, war (declared or not) or threat or preparations for war.
3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
4. Impossibility of using trains, ships, planes, motor transport or other means of transport, public or private.
5. Impossibility of using public or private telecommunications systems.
6. Acts, decrees, legislation, regulations or restrictions of any government or public authority.
7. Strike, failures or accidents of maritime or fluvial transport, postal or any other type of transport.
It will be understood that our obligations derived from the Contracts will be suspended during the period in which the Cause of Force Majeure continues, and we will have an extension in the term to comply with said obligations for a period of time equal to the duration of the Cause of Force Majeure. We will use all reasonable means to bring the Force Majeure Event to an end or to find a solution that enables us to perform our obligations under the Contract despite the Force Majeure Event.

14. Partial nullity
If either party does not exercise any of its rights under this contract, it will not be considered a waiver of said right unless expressly communicated in writing.
Even if any part of this contract is not considered legal or valid by a judicial body, the rest of the contract will continue to apply.
15. Applicable law
In the event of a dispute with these General Contracting Conditions, judicial jurisdiction will correspond to the judges and courts of the user's domicile.
